JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506 and 34 of the Indian Penal Code. Learned counsel submits that petitioner has antecedent of one case and that too of the year 2006, it is next submitted that petitioner presently is aged about 83 years and from perusal of the allegation as alleged in the FIR it would manifest that the allegation of assault is general and omnibus in nature i.e., no specific allegation of assault is alleged against the petitioner, it is also submitted that the present FIR is a counterblast to Rani Talab, P.S. Case No. 171 of 2021 instituted from

Patna High Court CR. MISC. No.20756 of 2022(2) dt.01-11-2022 2/2 side of the petitioner.

Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for anticipatory bail of the petitioner but are not in position to rebut the submission of the learned counsel for the petitioner that petitioner is aged about 83 years and allegation of assault is not specific against him. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rani Talab P.S. Case No. 172 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
