The petitioner seeks pre-arrest bail in connection with Lakhisarai P.S. Case No.65 of 2017 registered under Sections 409 and 420/34 of the Indian Penal Code.

Regard being had to the fact that though upon completion of investigation the police had submitted final report holding therein 'lack of evidence', the learned Magistrate differed with the police report and took cognizance of the offence, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
