JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302, 120B/34 of the Indian Penal Code. Allegation against the petitioner is that she along with other family members killed the daughter of the informant as she was not blessed with any child.
It has been submitted on behalf of the petitioner that she has got no criminal antecedent. She is mother-in-law of the deceased. She is separate from mess and property of the husband of the deceased and has no concern with the affairs of the husband and the deceased. She has been made accused due to mistake of fact.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on
Patna High Court Cr.Misc. No.39697 of 2015 (2) dt.30-09-2015 2 / 2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui, in connection with Chandramandih P.S.
