The petitioners seek bail in a case registered for the offence punishable under Section 302, 201, 120(B), 34 of the Indian Penal.

The prosecution case as lodged by the informant is that on 22.10.2018 at 5am her husband gone for morning walk but did not return. It is alleged that after search with villager they found dead body of the deceased. It is also alleged that petitioners are always fighting with deceased for a piece of land and also alleged that they murdered her husband. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.18477 of 2020(3) dt.02-07-2020 2/2 that they are innocent and have been falsely implicated in this case. He submits that no one has seen the petitioners with the deceased on 22.10.2018 but only on the basis of suspicion, petitioners' name have been included despite the fact that petitioners are own brother and bhabhi of the deceased. He submits that petitioner no. 1 is 70 years old person and petitioner no. 2 is also a handicapped woman. He further submits that petitioners are languishing in judicial custody since 14.10.2019.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case 293 of 2018.
