JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-01-2022 Heard the parties through virtual court proceedings. Learned counsel for the petitioners undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application, in order to seek regular bail before the learned court below.
Permission is granted.
The instant application is dismissed as withdrawn. However, the petitioners are directed to surrender before the learned court below within a period of six weeks from the
Patna High Court CR. MISC. No.31147 of 2021(2) dt.20-01-2022 2/2 date of receipt of a copy of this order and seek regular bail. The learned court below is directed to consider and dispose of the case of the petitioners, preferably on the same date in accordance with the merits of the case without being prejudiced by the withdrawal of the present application, keeping in view that earlier the petitioners were granted anticipatory bail by learned court below, but could not surrender in time to furnish the bail bonds.
