JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) (d) of the Bihar Prohibition and Excise Act. Prosecution case is that 225 litres country made liquor was recovered from a tempo.

Learned counsel appearing for the petitioner submits that the recovery has been made from the vehicle. The petitioner is not the owner nor driver of the vehicle in question. Nothing has been recovered from his possession.

Learned counsel for the State submits that the huge number of liquor recovered from the vehicle. He further submitted that the petitioner has got five criminal antecedents of similar nature.
