13-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video-conferencing. This relates to grant of bail in Kudhani P.S. Case No. 473 of 2017 (Turki O.P) registered for the offence under Section 392 of the Indian Penal Code.

As per F.I.R., on 01-12-2017 at about 1:30 o'clock (night), four unknown miscreants, after overtaking the vehicle of informant, surrounded & stopped him on gun-point and thereafter, they tied his hands, legs & mouth and pushed him from the vehicle and took away his car as also snatched the mobile phone and money of the informant.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. His name has surfaced on the confessional statement of co-accused. No incriminating article

Patna High Court CR. MISC. No.19450 of 2020(3) dt.13-07-2020 2/2 has been recovered from the possession of the petitioner. It is further submitted that till date, petitioner has not been put on T.I.Parade and he is in custody since 23-11-2019. However, learned A.P.P. for the State opposed the bail application of the petitioner and submitted that it is a case of road robbery on National Highway. Learned A.P.P. further submits that chargesheet has already been submitted against petitioner and petitioner has got criminal antecedent of similar nature.

Considering the aforesaid facts and circumstances, the bail application stands dismissed.
