JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 8.10.2019 in connection with Guraru P.S. Case No. 130/2019 registered for the offences punishable under Sections 341, 323, 448, 376D/34 of the Indian Penal Code.

Petitioner is named in the first information report with allegation that he along with two others committed rape on the informant but informant did not take name of petitioner in her statement recorded under Section 164 Code of Criminal Procedure. Moreover, some co-accused have already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.20438 of 2020(3) dt.21-09-2020 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate V, Gaya/concerned court in connection with Guraru P.S. Case No. 130/2019.
