2. Learned counsel for the petitioner submits that vide order dated 13.07.2023 a direction has been given to the counsel for the State to file supplementary counter affidavit. He submits that copy of same has been served upon him.

3. Learned counsel for the State submits that he has filed soft copy of the supplementary counter affidavit as well as hard copy of the same today in the Court itself. Learned counsel

Patna High Court CWJC No.18777 of 2014(4) dt.16-08-2023 2/2 for the State further submits that vide Annexure-C, the order has been passed on 25.10.2002 in which recommendation has been made for cancellation of settlement and matter was referred before the Collector, Kaimur.

4. Learned counsel for the petitioner submits that Annexure-C is not the cancellation order, rather it is recommendation for the cancellation.

5. In this view of the matter, petitioner is directed to challenge the same before the Collector, Kaimur to whom recommendation for cancellation has been made by way of filing representation alongwith copy of the order passed today, whereupon the Collector, Kaimur is directed to hear the petitioner and other persons interested in the said dispute and after granting opportunity of hearing to all the affected persons, he shall pass reasoned and speaking order in this matter within ten weeks from the date of filing of representation by the petitioner.

7. With this direction and observation, the present Writ Petition stands disposed off.
