The application is for grant of bail for the offence under Sections 304B, 201, 34 of the IPC and 3⁄4 Dowry Prohibition Act. It has been submitted on behalf of the petitioners that petitioner no.1 is mother-in-law and the petitioner no.2 is father-in-law of the deceased.
It has further been submitted that the allegation against the petitioners is that they caught the deceased and husband of the deceased administered thymade in her mouth. It has also been submitted that the case has been lodged after three months
Patna High Court Cr.Misc. No.55203 of 2016 (2) dt.09-01-2017 of the period, the dead-body of the deceased was disposed of. It is further been submitted that the petitioner No.1 is in custody since 17.09.2016 and the petitioner No.2 is in custody since 20.08.2016.
Heard learned A.P.P. also.
Having heard both sides. In view of the facts as stated above and also considering the period of custody of the petitioner, let the petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of CJM, Samastipur in connection with Patory P.S.Case No.337 of 2016.
