JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri Mukesh Kumar, learned counsel for the petitioners and learned Additional Public Prosecutor. Two petitioners, who are in custody in Vaishali P.S. Case No. 200 of 2016 registered for the offence under section 452 and 380 of the Indian Penal Code have prayed for grant of bail. It was submitted by learned counsel for the petitioners that petitioners are neighbors of the informant and animosity in between the petitioners and informant was going on, accordingly on false accusation petitioners have been made accused. He submits that in the F.I.R. informant has stated that he has seen the petitioners while fleeing away with the Rexin bag containing more than Rs. 200000/- . He submits that it is improbable that once petitioners were neighbors and were intending to commit

Patna High Court Cr.Misc. No.46240 of 2016 (2) dt.22-10-2016 2/2 theft in the house of the informant the petitioners should have concealed their face. He further submits that nothing has been recovered from the possession of the petitioners. In view of the facts and circumstances, let both the petitioner Rajesh Kumar Gupta and Ramesh Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur / concerned court in connection with Vaishali P.S. Case No. 200 of 2016.
