JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2020 The defect as pointed out by the office be ignored. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 448, 376(D)/34 of the Indian Penal Code.

Petitioner and two others are said to have committed rape on informant but Annexure-2 to the petition goes to show that informant had stated a different story in her statement recorded under section 164 of the Cr.P.C.

However, learned cousnel of the petitioner submits that co-accused Ranjan Yadav and Pintu Yadav have already been granted privilege of bail by different Benches of this Court.
