Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 307, 504, 379, 34 of the Indian Penal Code. The prosecution case is that all the accused persons assaulted the informant with fists and slaps. On alarm being raised the wife and son of the informant came to rescue then they were also abused and assaulted by accused persons. It is further alleged that co-accused Bittu Mandal put towel around the neck of the son of the informant and started pulling and thereafter this petitioner assaulted the son of the informant with Farsa on his head. The accused persons snatched earring of the wife of the informant. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.37797 of 2015 (2) dt.22-09-2015 2/2 petitioner that injury report reflects one injury of marginal size caused by hard and blunt substance to the son of the informant. Moreover the accusation has been levelled in the background of land dispute.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the accusation not being corroborated with the injury caused to the son of the informant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Pupri P.S. Case No. 91 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
