JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-03-2022 Heard Ms. Kusum Rani learned counsel for the petitioner and Mr. Ashok Kumar, learned APP for the State. Petitioner seeks regular bail in connection with Town P.S. Case No. 313 of 2020 registered for the offence punishable under Sections 401, 379, 413 and 414 of the I.P.C. A red coloured Pro Passion Hero bike having no registration number was intercepted by the Police on which the petitioner and one another co-accused were sitting and the said bike was found to be a stolen property.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of confessional statement and he has not committed any offence in the manner alleged. She next submits that the petitioner is in
Patna High Court CR. MISC. No.31943 of 2021(4) dt.09-03-2022 2/3 custody since 21.12.2020 having no criminal antecedent and the charge-sheet in the matter has already been submitted. She next submits that the petitioner disclosed the name of one Deepak Kumar Yadav, who had allegedly stolen the said bike and handed it over to him for selling the same and the said Deepak Kumar Yadav has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 42209 of 2021. She next submits that similarly situated co-accused who was arrested with the petitioner, namely, Vikash Kumar Yadav has been granted bail by this Court vide Cr. Misc. No.32525 of 2021. One another co-accused, namely, Sada Nand Yadav has also been granted bail by this Court vide Cr. Misc. No.35470 of 2021.
Regards being had to the submissions made by the parties and taking into consideration the materials available on record and the fact that petitioner has got no criminal antecedent, he is in custody since 21.12.2020 and the coaccused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, VIKASH KUMAR RAM, be released on regular bail on furnishing bail bond of Rs.
