JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302, 201 and 34 of the Indian Penal Code. Allegation in brief is that the son of this petitioner, who is step son of the deceased, alleged to have killed his step mother and it is alleged that petitioner is also participated in the cremation of the dead body.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was married with the deceased long back and he is 78 years old man. There is no allegation of any matrimonial discord. He further submits that deceased died of natural death and the allegation of killing is specific against Rajesh

Patna High Court Cr.Misc. No.54152 of 2016 (2) dt.21-12-2016 2/2 Kumar and not against this petitioner.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge 13th, Muzaffarpur in connection with Sakra P.S. Case No.218 of 2016.
