====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-06-2020 Heard the parties through the virtual court proceeding. The petitioners seek bail in connection with Abadpur P.S. Case No.14 of 2020 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 353, 332, 333, 427, 436, 120-B of the Indian Penal Code.

Prosecution case in brief is that on 08.02.2020, all the accused persons including the petitioners having with arms assembled in the premises of Abadpur P.S. and made attempt on police personnels and they also damaged the vehicles as parked in the premises of P.S and other articles. It has been alleged that the accused persons made obstruction in discharging the government duties.

No. 18490 of 2020(2) dt.03-06-2020 2/2 Learned counsel for the petitioners submits that the petitioners are innocent, have committed no offence and they have been falsely implicated in this case. It has further been submitted that there is no specific allegation against these petitioners as they were the member of unlawful assembly. There is no evidence regarding the involvement of the petitioners in the alleged occurrence and nothing has been recovered from the possession of the petitioners and petitioners are in jail custody since 10.02.2020.

Learned A.P.P. for the State has opposed the prayer. In the facts and circumstances of the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each only with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Katihar in connection with Abadpur P.S. Case No.14 of 2020.
