The petitioner seeks regular bail in connection with Turkauliya (Raghunathpur O.P.) P.S. Case No. 67 of 2019 instituted for the offences under Sections 394, 302 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2020, charge-sheet has been submitted in the case and he has got criminal antecedents as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that petitioner has been implicated in this case because of his criminal antecedents and based on the confessional statement of co-accused. He further submits that from bare perusal of the

No.30004 of 2021(2) dt.25-11-2021 2/3 allegation as alleged in the F.I.R. it would manifest that the informant has alleged that while his brother who was working as a Manager in a finance company was returning home after collecting certain amount, the informant received information that unknown accused persons had shot him as a result of which he died.
Learned counsel for the petitioner submits that F.I.R. was against unknown and one Chandan Ram was arrested based on secret information received by the police and the said Chandan Ram is said to have disclosed the name of one Sandeep Kumar as the assailant of the deceased. The learned counsel submits that the said Chandan Ram does not allege against the petitioner regarding firing at the deceased. He further submits that Chandan Ram, on whose confessional statement the name of this petitioner transpired in the case, has been granted bail by order dated 01.12.2020 in Cr. Misc. 27693 of 2020, thus the petitioner deserves to be enlarged on bail. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that Chandan Ram has been granted bail by this Court, petitioner is in custody since 26.02.2020 and charge-sheet has been submitted in the case, let

No.30004 of 2021(2) dt.25-11-2021 3/3 the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of Shri Manoj Kumar Singh, learned J.M. 1st Class, East Champaran, Motihari in connection with Turkauliya (Raghunathpur O.P.) P.S. Case No. 67 of 2019 subject to the condition as laid down under Section 437 (3) Cr.P.C. with a condition that in the event the petitioner, after trial commences, does not appear on two consecutive dates, the learned court below shall proceed to cancel his bail bonds.
