JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Begusarai Complaint Case No. 4 C of 2018, disclosing offences under Sections 406, 420, 323, 120(B) of the Indian Penal Code.

Allegation against the petitioners is that they have taken Rs.70,000/- for providing a job in foreign and provided a Visa which was found forged.

Submission of learned counsel for the petitioner is that the complainant and her husband in habit of lodging such type of case and there is no chit of paper in support of the allegation made by the complainant.

Patna High Court CR. MISC. No.20647 of 2019(2) dt.08-05-2019 2/2 Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioners on the ground that the Visa provided by the petitioners was found forged. Having heard both sides, so far petitioner no.1 is concerned, I am not inclined to grant anticipatory bail to the him, rather he may move for regular bail.

So far petitioner no.2 is concerned, considering the fact that she is a lady, this application is allowed. Let the petitioner no.2, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-III Cum A.C.J.M.-V, Begusarai, in connection with Begusarai Complaint Case No. 4 C of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

With the above observation, this application is disposed of.
