JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-06-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Kumar Khand P.S. Case No.134 of 2019 registered for the offences punishable under Sections 25 (1-b)a/26/35 of the Arms Act. The prosecution story of the case as per the informant Mukesh Kumar A.S.I. is that on 14.07.2019 at 8:00 hrs., he got a secret information that the criminals have looted a motorcycle and other articles near a bridge situated between village Khurda and Tapra Tola. Upon this information, the informant along with the police party went to the place of occurrence and recorded the statement of the victim Manoj Sah. Then he got an information that four persons, one of which is Randhir Yadav, riding on two CD Delux motorcycles and one Splendor Plus like motorcycle

Patna High Court CR. MISC. No.18519 of 2020(2) dt.03-06-2020 2/2 have gone towards west. Upon this information, the informant reached to the house of Randhir Yadav at about 8:15 P.M., where seeing the police party three persons fled away. Thereafter, in the house of Randhir Yadav one black colour Hero Honda CD Delux motorcycle bearing no. BR 43A 3028 and other motorcycle without any number plate was recovered. Learned counsel for the petitioner submits that the petitioner is innocent. The petitioner had gone to village Sukhasan to meet his relative but the allegation of recovery from this petitioner is false. The petitioner is in jail custody since 16.07.2019 and the charge sheet has already been filed. Learned A.P.P. for the State has opposed the prayer.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Madhepura in connection with Kumar Khand P.S. Case No. 134 of 2019.
