Petitioner, who is in custody, seeks bail in connection with Dalsingsarai P.S. Case No. 379 of 2015 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Informant who is the father of the deceased has alleged that petitioner along with other co-accused killed his son.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case on the basis of suspicion and there is no other incriminating material against the petitioner. He is not named in FIR. He has no criminal antecedent. He is in custody

Patna High Court Cr.Misc. No.63217 of 2018(2) dt.26-10-2018 2/2 since 06.05.2018. It has been further submitted that similarly placed co-accused, namely, Mosmat Babita Devi and Anil Mahto have been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 26349 of 2016 and 48503 of 2018 vide order dated 12.07.2016 and 25.09.2018 respectively. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Dalsingsarai District Samastipur in connection with Dalsingsarai P.S. Case No. 379 of 2015.
