JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mohania P.S. Case No. 346 of 2015 instituted for the offence under Sections 406, 420 and 386/34 of the Indian Penal Code. It is alleged that the informant received information that three persons are collecting illegal money from the owner of the truck carrying cattle. The informant reached the place of occurrence and arrested three persons. They disclosed that Police Inspector Jitendra Narayan Singh and other Inspector Sumer Kumar Singh have authorized them to collect money from the owners of truck carrying cattle.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.14951 of 2017 (2) dt.30-03-2017 2/2 the petitioner is not named in the written report. His name has come during investigation as a person who has granted leave to Jitendra Narayan Singh and Sumer Kumar Singh. It has been submitted that the petitioner is Secretary of State Prevention of Cruelty to Animals. It has further been submitted that Jitendra Narayan Singh and Sumer Kumar Singh have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 14.12.2015 passed in Cr. Misc. 50344 of 2015. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Mohania P.S. Case No.

346 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kaimur at Bhabhua, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
