JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-12-2021 Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioner and Ms. Asha Devi, Additional Public Prosecutor for the State via video conferencing. Petitioner seeks regular bail in connection with Bettiah (Mufassil) PS Case No. 725/2020 registered for the offence punishable under Sections 413 and 414 of the IPC. As per prosecution case, the police intercepted a stolen motorcycle driven by the petitioner and one another accused person.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedents and is in custody since 17.11.2020. Learned counsel further submits that coaccused, Ram Babu Kumar, with whom the petitioner was

Patna High Court CR. MISC. No.31384 of 2021(2) dt.10-12-2021 2/2 arrested, has been granted bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 20163/2021.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner has got no criminal antecedents and is in custody since 17.11.2020 and similarly situated co-accused, Ram Babu Kumar has already been granted bail by a Coordinate Bench of this Court, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, LALBABU KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Mufassil) PS Case No. 725/2020.
