Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 379 of the Indian Penal Code, registered in connection with Mansi P.S.Case No. 94 of 2019. The learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner to assault anyone, rather the allegation is general and omnibus. He has submitted further that there is land dispute

Patna High Court CR. MISC. No.23071 of 2022(2) dt.11-10-2022 2/2 between the parties and there is case and counter case in which cognizance has been taken against the informant. It appears that the allegation against the petitioner is general and omnibus. There is land dispute between the parties. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S.Case No. 94 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
