2. The petitioner seeks regular bail in connection with Naugachia P.S. Case No. 313 of 2023 lodged on 18.09.2023, for the offence punishable under Sections 457 & 380 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 12.07.2024 passed in Cr. Misc. No. 40694 of 2024 with liberty granted to the petitioner to renew his prayer for bail three months after framing of charge. Counsel submits that charge has already been framed in this case on 26.11.2024, but

Counsel further submits that the petitioner is in custody since 04.11.2023 i.e. more than one and a half year has been lapsed. Counsel submits that the only negative aspect against the petitioner is that his criminal antecedent is not clean as there are five cases pending against him.
4. Learned APP for the State opposes the prayer for bail of the petitioner.
5. In the present facts and circumstances of this case, let the above named petitioner be granted bail as well as on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are mentioned below, and on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of A.C.J.M., Naugachia in connection with Naugachia P.S. Case No. 313 of 2023, subject to the conditions as laid down U/s 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
