17-10-2016 Heard Sri Ajay Thakur, learned counsel, who was assisted by Sri Malay Kumar Choudhary, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is lady and is in custody since 15-07-2016, has prayed for grant of bail in Bishanpur P.S. Case No. 69 of 2016 registered for offence under Sections 323, 302, 504 of the Indian Penal Code.

By way of referring to F.I.R., it was submitted by learned counsel for the petitioner that there is no allegation that there was any intention on the part of the petitioner to kill husband of the informant, who was none else but father-in-law of the petitioner. He submits that on trivial dispute in between petitioner and wife of husband's brother, the father-in-law of the informant

Patna High Court Cr.Misc. No.40889 of 2016 (5) dt.17-10-2016 2/2 arrived there and in that occurrence, he received some injuries and subsequently died. By referring to F.I.R., it has been emphasized by the learned counsel for the petitioner that there was no intention to kill.

Keeping in view the allegation made in the F.I.R. as well as the fact that petitioner is a lady, let the petitioner namely Aruniya Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Darbhanga at Laheriasarai in connection with Bishanpur P.S. Case No. 69 of 2016.
