JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-06-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Naubatpur P.S. Case No. 472 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code. The F.I.R. of the occurrence of dacoity is against unknown.
Learned counsel for the petitioner submits that the petitioner is in jail custody since 21.07.2019. Investigation of the case is already complete. Petitioner was never put on T.I.P. nor any incriminating article was recovered from his possession nor there is any material to substantiate that the petitioner is going to tamper with the evidence or hamper the trial. Learned counsel for the petitioner further submits that similarly situated
Patna High Court CR. MISC. No.18468 of 2020(2) dt.03-06-2020 2/2 co-accused have been granted bail by this Co-ordinate Bench of this Court passed in Cr. Misc. No.73122 of 2019 dated 18.12.2019 and Cr. Misc. No.12143 of 2020 dated 29.02.2020. Learned A.P.P. for the State has opposed the prayer. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Danapur in connection with Naubatpur P.S. Case No.472 of 2019., subject to the following conditions :
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial court.
