The petitioner seeks bail in Bihariganj P.S. Case No. 193/2015, instituted for offences under Section(s) 302, 201 and 120(B)/34 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence after purchasing vegetable husband of informant had gone to Pushpraj Hotel for taking his remuneration. In the way he gave the bag of vegetable to his father. At about 6:15 P.M. informant learnt from villagers that her husband is lying dead in paddy field. The informant went there and found dead body of her husband. The informant alleged that earlier her husband had altercation with Binod Mukhiya and Taffi Mukhiya, who under conspiracy with two other accused persons have committed

Patna High Court CR. MISC. No.24398 of 2019(2) dt.16-04-2019 2/2 murder of her husband.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. In the Fardbeyan informant has raised suspicion against co-accused Binod Mukhiya. Aforesaid Binod Mukhiya has taken the name of this petitioner as one of the associate in committing murder of husband of informant.

Petitioner is in custody since 01.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Udakishunganj, Madhepura, in connection with Bihariganj P.S. Case No. 193/2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
