JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2020 Heard Mr. Ashok Kumar Jha, learned counsel appearing for the petitioner as well as Anil Kumar Singh No. 1, learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 9.12.2019 in connection with Bathanaha P.S. Case No. 158 of 2019 registered for the offences punishable under Sections 399, 414, 402 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.

The Office has pointed out that petitioner has given incomplete information at paragraph 3 of the petition but learned counsel of the petitioner submits that after institution of the present case, the petitioner was made accused in two other cases and correct information has been given at para 3 of the petition.

No.20694 of 2020(3) dt.14-09-2020 2/2 Taking note of the aforesaid submission as well as this aspect of the matter that neither the petitioner was caught at the spot nor anything recovered from his possession and some coaccused have already been granted privilege of bail by different coordinate Benches of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sitamarhi, in connection with Bathanaha P.S. Case No. 158 of 2019.
