JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioners seek regular bail in connection with Ara Muffasil P.S. Case No. 249 of 2018, registered for offences punishable under Sections 341, 323, 147, 148 and 307 of the Indian Penal Code.
Allegation against the petitioners is of assault with tangi and farsa to the son of the informant and causing injury to him.
Submission of learned counsel for the petitioners is that F.I.R. itself shows that there is land dispute between the parties and occurrence took place due to measurement of the land and moreover petitioners are in judicial custody since 31.07.2018.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.67130 of 2018(2) dt.27-11-2018 2/2 Having heard both sides, in view of the above facts, at this stage I am not inclined to grant bail to the petitioners. However, once the charge is framed against them or they complete six months in judicial custody, whichever is earlier, they shall be released by the concerned court below to his own satisfaction.
