The petitioner seeks bail in a case registered for the offence punishable under Section 304B/34 of the Indian Penal Code.
Earlier, prayer for bail of the petitioner was rejected vide order dated 27.10.2021 passed in Cr. Misc. No. 23033 of 2021.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner is the husband of the deceased. He further submits that the petitioner is languishing in judicial custody since 16.11.2020.
In pursuance to the order dated 13.07.2022, status report of trial in connection with Ara Nawada P.S. Case No. 887 of 2020 has been received and kept at Flag-R, in which it is
Patna High Court CR. MISC. No.21066 of 2022(5) dt.12-10-2022 2/2 reported that charge has been framed and case is committed to the court of Sessions within one month.
Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Ara Nawada P.S. Case No. 887 of 2020 pending before the court of the learned Chief Judicial Magistate, Ara.
Accordingly, the application is dismissed.
However, petitioner is at liberty to renew his prayer for bail after examination of the informant in the trial. (Anjani Kumar Sharan, J) devendra/- U T
