JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Supaul P.S. Case No. 630 of 2018, disclosing offences under Sections 366(A), 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Rather, the girl was kept to her house and the statement under Section 164 of Cr.P.C. also does not disclose that she was forcibly taken away by the petitioner.

Heard learned A.P.P. also, who has opposed the prayer for bail by stating that the girl was minor and she has supported the prosecution case in her statement under Section 164 of Cr.P.C.

No.18397 of 2019(3) dt.18-06-2019 2/2 Having heard both sides, in view of the facts, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner shall surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned trial court without prejudiced by the order of this Court.
