====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 05-07-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 324, 308, 379, 506 and 34 of the Indian Penal Code.
The informant alleges that on 30.04.2020, the accused persons including the petitioners threatened his son to keep liquor, ganja and medicines in his shop for selling and when the same was objected, it is alleged that petitioner no. 1 assaulted the informant with dabiya causing injury on
Patna High Court CR. MISC. No.21681 of 2023(2) dt.05-07-2023 2/3 head, petitioner no. 2 assaulted his son with an iron rod causing injury on his lips and he became unconscious, thereafter, Bablu snatched Rs. 2,000/- from pocket of the informant and Monu pointed gun at him.
Learned counsel for the petitioners submits that the petitioner no. 1 is a person with clean antecedent and petitioner no. 2 has antecedent of one case, it is next submitted that petitioners have been falsely implicated in the present case, it is further submitted that parties are agnates and closely related. Learned counsel next submits that there is a counter case and the injuries suffered are simple in nature and the parties on the intervention of well wishers have compromised the case.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
