====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

It is a case of dowry death.

Petitioner is mother-in-law of the deceased.

Learned counsel appearing for the petitioner submits that petitioner is separate in mess and property and is not concerned with the family affairs of the deceased. It is next submitted that main thrust of accusation is against husband of the deceased who is already in custody. Petitioner has got clean antecedent.

Learned counsel for the State vehemently opposes the

Patna High Court CR. MISC. No.20853 of 2023(2) dt.28-06-2023 2/2 bail application.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-6th, Siwan in connection with Nautan P. S. Case No. 289 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
