Petitioner is in custody since 15.10.2016 in connection with Jagdishpur P.S. Case No. 243 of 2016 registered under Sections 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act.

According to the prosecution, 194 pouch each containing 200 M.L. country-made liquor were recovered from a Tempo bearing No. BR-10-PA-3092.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed offence. The petitioner has been taken into custody merely on suspicion as because the petitioner was traveling at that point of time in the alleged Tempo when the police checking was going on.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in connection with Jagdishpur P.S.
