JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2017 Heard leaned counsel for the petitioners and the leaned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kunauli P.S. Case No. 47 of 2016, registered under Section 304B/34 of the Indian Penal Code, pending in the court of Sri A.K. Pandey, Judicial Magistrate, Birpur (Supaul). The accusation is of killing of daughter of the informant by her father-in-law and mother-in-law due to nonfulfillment of demand of dowry. Learned counsel for the petitioners submits that petitioners are the father-in-law and mother-in-law of the deceased and both have falsely been implicated in this case mere on suspicion. Further submission is that at the time of occurrence,

Patna High Court Cr.Misc. No.11861 of 2017 (3) dt.25-04-2017 2/2 both the petitioners were in field and on hearing hulla, both of them came at the house and saw that deceased committed suicide by putting fire on her person.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
