JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 The petitioner being mother of the husband of the sister of the informant is languishing in custody since 01.04.2016 in a case registered for the offences punishable under Sections 498A, 304B, 120B of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of killing the sister of the informant after about five years of marriage for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the entire in-laws family including the petitioner. The petitioner is old lady and the impugned order reflects that the inquest report reflects only one injury on the neck of the victim. The investigation has already concluded. It is further submitted that accusation of demand of dowry after about five years of marriage does not appear to be reasonable. Moreover the

Considering the fact that investigation has already concluded and the petitioner being lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Patna in connection with Maranchi P.S. Case No. 18 of 2016.
