JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-04-2019 Learned counsel for the petitioners is permitted to make necessary correction in para-1 and 5 in course of the day. Petitioners are in custody in connection with Begusarai Town P.S. Case No. 646 of 2018 for the offence under sections 341, 342, 323, 324, 504, 384/34 of the Indian Penal Code and 27 of the Arms Act in which Sections 363, 326, 307, 292, 293, 294, 506, 509, 120B and 377 read with section 109 of the Indian penal Code and Section 66(E) and 27(B) of the Information Technology Act.

Learned counsel for the petitioners submits that the name of the petitioners surfaced on the confessional statement of co-accused. He submits that similarly circumstanced co-

Patna High Court CR. MISC. No.19665 of 2019(2) dt.01-04-2019 2/2 accused namely, Chotu Kumar @ Raj Kumar, Rahul Kumar and Ganesh Kumar have been granted bail by a coordinate Bench of this Court in Cr. Misc. Nos. 10741 of 2019 and 12194 of 2019 vide order dated 22.2.2019 and 01.03.2019.

The petitioners are in custody since 26.10.2018 and they have got no criminal antecedent.

Having regard to the fact that petitioners have no criminal antecedent and they have remained in custody for approximately five months and the fact that similarly circumstanced other co-accused have been granted bail, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 646 of 2018.
