The petitioner seeks bail in a case registered for the offence punishable under Sections 400, 401, 402, 414, 34 of the Indian Penal Code and Section 20/22 of the NDPS Act. Prosecution case as lodged by the police personnel is that on secret information some miscreants were assembled behind Sonali Hospital with three motorcycles who were planning to do some occurrence, a raid was conducted and apprehended some persons along with the petitioner. On search, three mobiles and a key were recovered from the possession of the petitioner.

Patna High Court CR. MISC. No.18545 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case. He submits that after perusal of the FIR as well as seizure list it is alleged therein that one touch screen, two key pad mobile and a TVS Motorcycle key ring were recovered from him which belongs to him. He submits that neither Sections I.P.C. nor N.D.P.S. attracts against the petitioner. He further submits that petitioner has no criminal antecedent and is in custody since 15.01.2020.

Learned counsel for the State vehemently opposes the prayer for bail.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Ahiyapur Police Station Case No. 53 of 2020.
