The petitioner seeks bail in a case registered for the offence punishable under Sections 20/22 of the N.D.P.S. Act. Prosecution case as lodged by the police personnel is that on secret information that some people have assembled for the purpose of selling and purchasing of smack (Charas), a raid was conducted. On seeing police party, all the persons started to run away but after chase, five persons including the petitioner were arrested. On search, 11 pouch of one gram charas was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that there is

Patna High Court CR. MISC. No.18562 of 2020(3) dt.24-06-2020 2/2 recovery of 11 grams of charas from the possession of the petitioner. He submits that petitioner has no criminal antecedent as stated in para-3 of the bail application. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses. He further submits that similarly situated co-accused have been granted the privilege of bail by coordinate Benches of this Court in Cr. Misc. No. 12619 of 2020 and Cr. Misc. No. 14741 of 2020. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Patna in connection with Special Case No. 146 of 2019 arising out of Pirbahore Police Station Case No. 554 of 2019.
