Petitioner seeks bail in Gopalganj Town P.S. Case No.476 of 2018 instituted for the offence under Section(s) 414, 413, 420, 379, 467, 468, 471, 120-B Indian Penal Code. Counsel for the petitioner submits that petitioner was apprehended merely on suspicion.

In the written report, it is alleged that during patrolling duty informant got information that a Scorpio vehicle was standing on the road from some distance of SBI ATM in Jadopur road from which persons were seen going to ATM one by one. The informant reached there and found one person was present in ATM. Police apprehended that person in suspicious

Patna High Court Cr.Misc. No.63458 of 2018 (2) dt.12-10-2018 2/2 condition, who told that his colleagues are sitting in Scorpio. The police apprehended those persons, but no incriminating articles were recovered from their possession. They disclosed their names as Azad Alam and Santosh Kuamr Yadav. Petitioner was also sitting in the aforesaid vehicle along with other accused. It is alleged that from possession of petitioner twelve ATM Cards of different bank and rupees five thousand was recovered. Petitioner is in custody since 18.08.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No.476 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
