Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 392 of the Indian Penal Code.

Prosecution case as lodged by the informant is that he is private clerk of finance company and he was returning to his head office of Ramgarhwa from Mangalpur Patani and he reached railway gate 300 mitre of distance in Patani village in the meantime, unknown miscreant surrounded him and snatched the bag on the point of knife in which Rs. 51,530/- was kept and fled away from there and after information Branch Manager

Patna High Court CR. MISC. No.18547 of 2020(3) dt.02-07-2020 2/2 came there and FIR was lodged. .

Learned counsel for the petitioner submits that he is innocent, not named in the F.I.R and has been falsely implicated in this case only on suspicion. He submits that till date no TIP has been done by the police. He submits that no body has identified the petitioner on the spot and he is languishing in custody since 03.08.2019.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail, therefore, the bail application of the petitioner is rejected in connection with Ramgadhwa Police Station Case No. 300 of 2018 pending before the court of the learned S.D.J.M., Motihari, East Champaran.

Accordingly, this application is dismissed. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
