The petitioners apprehend their arrest in Manihari P.S. Case No. 113 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioners and others came and forcibly fixed the electric pole in her land. When the informant objected the petitioner is said to have assaulted the informant with Lathi on her head. The accused persons also assaulted the family members of the informant. Learned counsel for the petitioners submits that on account of some land dispute the false case has been lodged. The
Patna High Court Cr.Misc. No.11276 of 2017 (4) dt.23-06-2017 2/2 informant got superficial scratch of 1/8"x1/8"x1/8" on her head. There is no specific allegation of assault against the petitioner no. 2.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar in Manihari P.S. Case No. 113 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
