====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nagar (Buxar) P.S. Case No. 30 of 2019 (Special Case No. 5 of 2019), instituted for the offence under Section(s) 420, 409 of Indian Penal Code, Sections 13(i)/A/D(i)(ii) of Prevention of Corruption Act, 1988. It is alleged in the written report that on receiving information from the higher official for making enquiry and taking needful action in Buxar District Transport office, due to allegation of collecting illegal money, the informant along with other police personnel reached at the office of DTO, Buxar. On seeing the police party, persons working with the computer became panic. Upon query, person who was working in the

Patna High Court CR. MISC. No.19199 of 2019(2) dt.29-03-2019 2/2 room disclosed his name as Md. Firoz (petitioner) from whose possession Rs.940/- has been recovered.

Counsel for the petitioner submits that Rs.940/- which was recovered was personal money of petitioner. He was keeping the aforesaid money to use for travel to Buxar daily to join his duty.

Petitioner is in custody since 13.01.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Patna, in connection with in Nagar (Buxar) P.S. Case No. 30 of 2019 (Special Case No. 5 of 2019), subject to the condition that both the bailors will be close relatives of the petitioner.
