====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Lalganj P.S. Case No. 288 of 2018, instituted for the offence under Section(s) 302, 120(B) of Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the written report.

It is alleged in the written report that son of the informant was shot dead in the Medical shop. The informant has further alleged that his son had told him about four days back that he has land dispute with this petitioner and petitioner had given threat to give Rs.5 lacs, otherwise he would be killed.

Patna High Court CR. MISC. No.18809 of 2019(2) dt.28-03-2019 2/2 From the written report it appears that informant is not eye witness of the occurrence. There is no allegation of any specific overt act against petitioner besides suspicion raised in the written report.

Petitioner is in custody since 28.01.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 288 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
