BADAR ORAL ORDER 09-05-2022 The applicant/accused in Crime No. 65 of 2015 registered with Bithan Police Station for the offences punishable under Section 302 read with Section 34 of the Indian Penal Code as well as Section 27 of the Arms Act, by this application is seeking his release on bail during pendency of the trial.

Heard the learned counsel appearing for the applicant/accused. He argued that the applicant has been falsely implicated in the subject crime.

I have heard learned Additional Public Prosecutor as well as learned counsel for the first informant. It is

The applicant was arrested only in the year 2019. In between five serious offences have been registered against the applicant and those includes the offences of murder as well as attempt to commit murder of policemen by firing bullets at them.

I have considered the submissions so advanced and also perused the materials placed before me. It is averred by first informant Babloo Yadav that his mother was done to death by the applicant and his associate Kameshwar Yadav by firing a bullet at her. Specific role of firing a bullet at deceased Sunita Devi is attributed by the first informant. Post mortem report support the case of the prosecution. There are eyewitnesses to the incident. The applicant is having chequered history of offences against human body. No case for grant of bail is made out in the light of the fact that the sessions case is at an advance stage of recording of evidence. Hence, this application is rejected. The applicant to remove all office objections forthwith and the Registry to issue the certified copy of this
