Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and 27 of the Arms Act.
Submission of the petitioner is that co-accused Sri Yadav and others were allowed anticipatory bail in Cr. Misc. No. 29533 of 2014 for the reason that the police had submitted final form against them. However, the learned court below differing with the police report took cognizance against those persons. The case of the petitioner is also of similar footing as he was also not sent up for trial after investigation. Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc.
