JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 386 of the Indian Penal Code and Section 27 of the Arms Act. The first information report reflects that on the order of FIR named accused Basudeo Yadav @ Bhushan Yadav, Diwakar Yadav and Binod Yadav @ Karu Yadav as well as others including petitioner made indiscriminate firing causing death of husband and son of the informant. Postmortem reports of both the above stated deceased reveal that both deceased sustained several firearm injuries.

Patna High Court CR. MISC. No.69618 of 2018(6) dt.20-05-2019 2/2 A co-ordinate bench of this court taking note of the aforesaid fact rejected the prayer for bail of co-accused Binod Yadav @ Karu Yadav vide order dated 08.02.2019 passed in Cr. Misc. No. 2899 of 2019.

In my view, it is not a fit case to grant bail to the petitioner, at least, for present and, therefore, the prayer for bail of the petitioner in connection with Ghoswari P. S. Case No. 23 of 2018 stands rejected.

However, a co-ordinate bench of this court has already directed the learned trial court to expedite the trial of coaccused Binod Yadav @ Karu Yadav and to conclude the same within a period of one year from the date of receipt/production a copy of the aforesaid order.

The learned trial court is directed to conclude the trial of the petitioner within the above stated period as directed by a co-ordinate bench of this court vide order dated 08.02.2019 passed in Cr. Misc. No. 2899 of 2019.
