Petitioner, who is in custody, seeks bail in connection with S. Tr. No. 188 of 2018 arising out of Shaebpur Kamal P.S. Case No. 122 of 2017 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

Informant alleged that when he was at the counter of his petrol pump four miscreants armed with pistol came there and started assaulting his staffs and thereafter looted 90,000/- at the counter and fled away.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been

Patna High Court Cr.Misc. No.64998 of 2018(2) dt.05-11-2018 2/2 falsely implicated in this case. He is not named in the FIR. Name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Rajan Das. Nothing has been recovered from the possession of the petitioner. He is in custody since 07.09.2017. It has been further submitted that similarly placed co-accused has been granted bail by another coordinate Bench of this Court in Cr. Misc. No. 54779 of 2018 vide order dated 28.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Begusarai in connection with S.Tr. No. 188 of 2018 arising out of Sahebpur Kamal P.S. Case No. 122 of 2017.
