JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the step-mother of the victim is apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.
It is submitted by learned Sr. Counsel for the petitioner that specific accusation of demand of dowry and taking away jewellery is against Narayan Paswan father of the husband of the victim when it is only alleged against the petitioner that she along with brother and sisters of the husband of the victim used to call the victim as 'blackee'. Though the FIR specifically suggests that this petitioner used to reside at Dhanbad and not with the husband

Considering the thrust of accusation against the husband of the victim and father of the husband of the victim and the petitioner being a lady, let her be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Khirimore P.S. Case No.69 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
