In this case, the petitioner is seeking regular bail in connection with Manjhi P.S. Case No. 228 of 2015 (U.T. No.26 of 2016), registered for the offence publishable under Section 395 of the Indian Penal Code.

As it appears from the order passed by the Additional Sessions Judge, 8th Saran at Chapra, that the looted mobile was recovered form the possession of the petitioner and other accused persons have accepted their involvement in the crime and so much so that the petitioner has been identified in the Test Identification Parade.

In such view of the matter, this Court is not inclined

Patna High Court Cr.Misc. No.39466 of 2016 (2) dt.17-09-2016 2/2 to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
